Please read these Terms and Conditions carefully, as they contain important information about your legal rights, remedies, and obligations. Flash Charge is an EV charging service operated by Automation Gallery Pvt Ltd (“Flash Charge”, “we”, “us”, or “our”).

By accessing or using our website, our mobile application, or our charging services (collectively, the “Platforms”), you agree to comply with and be bound by these Terms. If you do not agree with them, please do not use our Platforms or services.

Overview of Services

Our Platforms provide information about the Flash Charge EV charging network, including station locations, station ownership and distributorship opportunities, and access to a cloud-based ecosystem built to improve the charging network.
The Platforms also allow customers to locate stations, start and manage charging sessions, and book and pay for services.
Our Platforms may contain links to third-party websites or resources. Those services are governed by their own terms and conditions, and Flash Charge is not responsible for their availability, content, or accuracy.

Modifications to the Terms

Flash Charge reserves the right to modify these Terms at any time.
Any updated Terms will be published on our Platforms along with a revised date.
Your continued use of our Platforms or services after an update constitutes acceptance of the updated Terms.

Account Responsibilities

As a registered user, you are responsible for maintaining the confidentiality and security of your account credentials.
Payments and transactions made through your account are deemed genuine and valid.
You must notify us promptly if you believe your account has been accessed without your authorisation.
You are responsible for all charges incurred under your account, including unauthorised use that you have failed to report promptly.

Intellectual Property Rights

All intellectual property rights in the Platforms, including the Flash Charge name, logo, software, content, and design, are the exclusive property of Automation Gallery Pvt Ltd.
No licence or right is granted to you except as expressly stated in these Terms.
You may not copy, reproduce, modify, or distribute any part of the Platforms without our prior written consent.

Payment Processing

Charging services are chargeable at the tariff displayed at the station and in the Flash app. We reserve the right to revise tariffs with reasonable notice.
Payments on our Platforms are facilitated by Razorpay. All payments processed through it are considered valid.
Flash Charge is not responsible for fraudulent transactions carried out using your credentials or payment instrument.
You may pay through the approved methods offered in the app, including UPI, credit and debit cards, net banking, and the Flash wallet.

Refund Policy

You may request a refund for issues such as an erroneous charge or a service failure within 6 months of the transaction.
Refund requests are subject to verification and approval.
Approved refunds are processed within 5 to 7 business days to the original payment method or the Flash wallet, as applicable.

Reviews and Ratings

You may submit public reviews and ratings about your experience with our stations and services.
Reviews must be accurate and must not contain offensive, misleading, or defamatory content.
We reserve the right to remove any review that breaches these Terms or applicable law.

Restrictions and Prohibited Uses

You must not violate any applicable law, agreement, or third-party right when using our Platforms.
You must not use automated means to access, scrape, or interact with our Platforms.
You must not engage in any activity that damages or impairs the performance or security of our Platforms.
You must not tamper with, damage, or misuse any Flash Charge charging equipment.

Termination and Suspension

Flash Charge may terminate or suspend your access to the Platforms without notice if you breach these Terms or any applicable law.
We may also suspend access where necessary to protect the safety or security of our network and users.
You may close your account at any time; amounts due for completed sessions remain payable.

Limitation of Liability

Flash Charge disclaims all liability for incidental, special, consequential, or exemplary damages arising from your use of the Platforms or services.
Our aggregate liability is limited to the amounts paid by you for the services obtained through the Platforms.
Charging station availability may be affected by grid supply, network connectivity, maintenance, or factors beyond our control.

Indemnification

You agree to indemnify and hold Automation Gallery Pvt Ltd, its officers, employees, and partners harmless from any claim, loss, or damage arising out of your use of the Platforms or your breach of these Terms.

Dispute Resolution and Governing Law

All disputes arising out of or in connection with these Terms shall be settled by arbitration under the Arbitration and Conciliation Act, 1996.
The seat of arbitration shall be Kochi, Kerala, and the proceedings shall be conducted in English.
These Terms are governed by the laws of India, and the courts at Ernakulam, Kerala shall have exclusive jurisdiction.

Feedback

Any feedback, suggestions, or ideas you submit are considered non-confidential.
Flash Charge may use such feedback for any purpose, including improving our products and services, without obligation or compensation to you.
